    Welcome to Adle AI, a product of Clapp Technologies, LLC ("Adle AI," "we," "us," or "our"). We respect your privacy and are committed to protecting your personal information. This Privacy Policy ("Policy") explains how we collect, use, disclose, and safeguard your information when you use our website, applications, and services (collectively, the "Services"). By using our Services, you agree to the practices described in this Policy.

    1. Who We Are and Our Role

    Clapp Technologies, LLC, a Delaware limited liability company doing business as Adle AI, is the controller of personal information collected directly through our Services.

    When you use Adle AI to run advertising campaigns on third-party platforms such as Meta, Google, and TikTok, you act as the controller of any customer or audience data you upload or process through the Services. In that context, Adle AI acts as your processor and processes that data on your behalf and under your instructions. Business customers may request a Data Processing Agreement (DPA) by contacting privacy@adle.ai.

    2. Information We Collect

    2.1 Information You Provide

    • Account Information: Name, email address, phone number, company name, country, and billing information.
    • Authentication Data: Login credentials and OAuth tokens for connected platforms (Meta, Google, TikTok, and others) when you authorize the integration.
    • User Content: Ad creatives, copy, images, videos, audience lists, campaign settings, and any other data you upload or generate through the Services.
    • Communications: Information you send us through support requests, feedback, surveys, or other channels.
    • Marketplace Information: When you purchase through a third-party marketplace such as AppSumo, we receive your purchase information, license codes, and any account details the marketplace shares with us.

    2.2 Information Collected Automatically

    • Usage Data: Pages visited, features used, activity times, session duration, and interactions with the Services.
    • Log Data: IP addresses, browser type, operating system, referrer URLs, device identifiers, and access times.
    • Cookies and Similar Technologies: We use cookies, pixels, and similar technologies to operate the Services, remember your preferences, analyze usage, and (with your consent where required) deliver and measure marketing. See Section 8 for details.

    2.3 Information from Third Parties

    • Advertising Platforms: When you connect Meta, Google, TikTok, or other advertising accounts, we receive campaign performance data, account information, and other data those platforms make available through their APIs.
    • Marketplaces: AppSumo and similar marketplaces share purchase and license information with us to fulfill your order.
    • Analytics and Marketing Partners: We may receive information about how you found our Services from analytics providers and referral sources.

    2.4 Google API Services

    Adle AI's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We do not use data obtained from Google Workspace APIs to develop, improve, or train generalized artificial intelligence or machine learning models.

    3. How We Use Information

    We use the information we collect for the following purposes:

    • Providing the Services: Operating, maintaining, and delivering the Services to you, including running campaigns on connected advertising platforms.
    • Account Management: Creating and managing your account, processing payments, and providing customer support.
    • Improvement and Analytics: Analyzing usage patterns to improve features, performance, and user experience.
    • AI and Automation: Using your account-level usage data and aggregated, anonymized performance data to improve our internal AI features. We do not use your private User Content (ad creatives, audiences, campaign data) to train generalized public AI models.
    • Communication: Sending service-related emails (welcome emails, billing notices, security alerts, product updates) and, with your consent where required, marketing communications.
    • Security and Fraud Prevention: Protecting the Services, detecting and preventing fraud, abuse, and security incidents.
    • Legal Compliance: Complying with legal obligations, responding to lawful requests, and enforcing our Terms.

    4. Legal Bases for Processing (EU/UK/EEA Users)

    If you are located in the European Union, United Kingdom, or European Economic Area, we process your personal information under the following legal bases:

    • Contract: Processing necessary to provide the Services you requested (Article 6(1)(b) GDPR).
    • Legitimate Interests: Processing for our legitimate business interests, including improving the Services, security, fraud prevention, and direct marketing to existing customers, where those interests are not overridden by your rights (Article 6(1)(f) GDPR).
    • Consent: Where required, such as for non-essential cookies and certain marketing communications (Article 6(1)(a) GDPR). You may withdraw consent at any time.
    • Legal Obligation: Processing necessary to comply with applicable law (Article 6(1)(c) GDPR).

    5. Sharing of Information

    We share information with the following categories of recipients:

    • Advertising Platforms: Meta, Google, TikTok, and other platforms you connect, in order to create and run your campaigns.
    • Infrastructure and Hosting Providers: Cloud hosting, database, and storage providers that operate our infrastructure.
    • Payment Processors: Stripe and similar providers, to process subscription payments and marketplace settlements.
    • Marketplace Partners: AppSumo and other authorized marketplaces, for license fulfillment, support, and refund processing.
    • Communication and Support Tools: Email delivery providers, customer support platforms, and analytics providers.
    • Affiliates: Other entities within the Clapp Technologies, LLC corporate group, where applicable.
    • Professional Advisors: Lawyers, accountants, and auditors, under confidentiality obligations.
    • Legal Authorities: When required by law, court order, or to protect our rights, users, or the public.
    • Business Transfers: In connection with a merger, acquisition, financing, reorganization, or sale of assets, in which case your information may transfer to the successor entity.
    • With Your Consent: Any other sharing for which you provide consent.

    We do not sell personal information for monetary consideration. Some advertising activities may qualify as "selling" or "sharing" under California law (see Section 11).

    6. Data Retention

    We retain personal information only as long as necessary for the purposes described in this Policy:

    • Account data: Retained while your account is active and for up to 90 days after account deletion to allow recovery and resolve disputes.
    • Campaign and User Content: Deleted upon cancellation of your subscription, except where retention is required to provide the Services to other users or to comply with legal obligations.
    • Billing and tax records: Retained for up to 7 years to comply with applicable financial and tax regulations.
    • Marketing communications data: Retained until you unsubscribe, plus a short reasonable period for record-keeping.
    • Logs and security data: Retained for up to 12 months for security, fraud prevention, and operational purposes.

    We may retain anonymized or aggregated data indefinitely as it can no longer be used to identify you.

    7. Data Security

    We implement reasonable administrative, technical, and physical safeguards to protect your personal information, including encryption in transit, access controls, and monitoring. However, no method of transmission or storage is fully secure, and we cannot guarantee absolute security.

    If we become aware of a personal data breach affecting your information, we will notify affected users and applicable regulators in accordance with applicable law.

    8. Cookies and Tracking Technologies

    We use cookies and similar technologies to operate the Services, remember preferences, analyze usage on our marketing websites, and deliver and measure advertising. Unless you previously opted out in this browser, analytics and marketing technologies may load by default on our Site (implicit consent region); you may change this at any time via the Cookie preferences link or related controls.

    • Strictly necessary cookies are required for the Services to function and related security protections.
    • Analytics cookies (such as analytics tools we configure through Google Tag Manager), advertising pixels (including Meta and TikTok pixels where deployed through our containers), DataFast analytics on our domain, and product analytics providers help us measure performance.

    You can manage cookie preferences via the Cookie preferences link and "Do Not Sell or Share My Personal Information" link in our footer, our standalone Cookie Policy, your browser settings, or periodic preference renewal (preferences you save may expire after twelve months per our Cookie Policy). Disabling certain cookies may limit functionality.

    9. Automated Decision-Making

    Adle AI uses automated systems and AI models to recommend audiences, generate ad creatives, optimize bidding, and adjust campaigns. These automated processes assist your decision-making but do not make decisions that produce legal or similarly significant effects on you without your involvement. You retain control over your campaigns at all times. If you have concerns about automated processing, contact privacy@adle.ai.

    10. Your Rights

    Depending on your jurisdiction, you may have the following rights:

    • Access: Request a copy of the personal data we hold about you.
    • Correction: Request correction of inaccurate or incomplete data.
    • Deletion: Request deletion of your personal data, subject to legal exceptions.
    • Restriction: Request that we limit the processing of your data.
    • Portability: Request your data in a commonly used, machine-readable format.
    • Objection: Object to processing based on legitimate interests or for direct marketing.
    • Withdraw Consent: Where processing is based on consent, withdraw consent at any time.
    • Lodge a Complaint: Lodge a complaint with your local data protection authority.

    11. California Privacy Rights (CCPA / CPRA)

    If you are a California resident, you have additional rights under the California Consumer Privacy Act and California Privacy Rights Act:

    • Right to Delete personal information we have collected, subject to exceptions.
    • Right to Correct inaccurate personal information.
    • Right to Opt Out of Sale or Sharing of personal information. While we do not sell personal information for money, our use of advertising cookies and pixels may qualify as "sharing" under California law. You may opt out at any time using the "Do Not Sell or Share My Personal Information" link in our website footer or by emailing privacy@adle.ai.
    • Right to Limit Use of Sensitive Personal Information.
    • Right to Non-Discrimination for exercising your rights.

    You may designate an authorized agent to make a request on your behalf. We will verify your identity before processing requests.

    12. Children's Privacy

    Our Services are not intended for children under 16 years of age. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us at privacy@adle.ai and we will take steps to delete it.

    13. International Data Transfers

    We are based in the United States, and your information may be transferred to, stored, and processed in the United States or other countries where we or our service providers operate. These countries may have data protection laws that differ from those in your jurisdiction.

    For transfers from the EU, UK, or EEA, we rely on appropriate safeguards where required, such as Standard Contractual Clauses, to protect your information. Contact privacy@adle.ai for more information about these safeguards.

    14. Third-Party Links and Services

    The Services may contain links to third-party websites, plugins, or services. This Policy does not apply to those third parties. We encourage you to review their privacy policies before providing them with information.
